Rental and website terms
Part 1 covers renting equipment from KleenSlate Creative. Part 2 covers using this website and the client portal. How we handle your information is in our privacy policy.
Part 1: Rental terms
1. The signed agreement controls
These rental terms summarize the standard Equipment Rental Agreement that you read and sign online for each booking. The agreement you sign is the controlling document. If anything on this page differs from your signed agreement, or from the quote you accepted, the agreement and the quote control. You receive a signed PDF copy by email and can open it at any time in the client portal.
2. How a booking works
- You send a quote request. A request does not reserve any equipment.
- We check availability and send you a quote. It shows the equipment, the rental days, any delivery, any discount, sales tax, the deposit, and the refundable security deposit. Equipment is held for you while the quote is open, up to the date the quote is valid until.
- You accept the quote in the client portal.
- You read and sign the rental agreement online.
- You pay the deposit. Your booking is confirmed once the agreement is signed, the deposit is paid, and we have confirmed the equipment is still available.
- Equipment is handed over at pickup or delivery and checked back in at return (see pickup, delivery and return).
- After return we send a final invoice.
3. Pricing, deposits and payment
Rates are per day, with a weekly rate for longer rentals where one is listed. Your quote is your price: it shows your total including sales tax. A deposit is due to confirm the booking, and the balance is due as stated on your invoice.
A refundable security deposit, shown on your quote and your deposit invoice, is held against loss, damage and late return. It is released after the equipment is checked in, less any amounts owed under the agreement. After return, the final invoice credits the deposit you paid and adds anything owed, such as late fees or damage.
Each invoice shows how to pay. Promo codes, where we offer one, are applied by our team to your booking and shown on your quote. If delivery is arranged, the delivery address, time window and fee are shown on your quote.
4. Insurance and certificate of insurance
You must carry insurance covering the full replacement value of the equipment against loss, theft and damage, plus commercial general liability insurance, for the entire rental period. Before the equipment is released you must provide a current certificate of insurance (COI) that names KleenSlate Creative as certificate holder and additional insured / loss payee. You can upload it in the client portal under Documents, and our team reviews it. We may refuse or withdraw the equipment if a satisfactory COI is not on file.
5. Your responsibilities for the equipment
- Use the equipment only for its intended purpose, by trained and competent people, and following the manufacturer's instructions.
- Keep it in your possession and control. Do not sublet, lend, sell, pledge or move it outside the agreed production location without our written consent.
- Inspect it at pickup or delivery and tell us at once about any defect or missing item. Equipment is presumed delivered complete and in good working condition unless you report otherwise at that time.
- Keep it clean and return it in the same condition, ordinary wear excepted, with all cases, cables, batteries, chargers and accessories.
- Do not modify, open, repair or try to service it.
6. Pickup, delivery and return
At pickup or delivery, and again at return, we go through a checklist item by item, record condition notes and photos, and note who received or returned the equipment. Those records help settle any question about condition. We email a reminder the day before your return date and a notice if equipment is overdue.
7. Loss, damage and replacement cost
Risk of loss, theft and damage passes to you at pickup or delivery and stays with you until we have checked the equipment back in. You are responsible for the repair cost of any damage and, for equipment that is lost, stolen or damaged beyond economical repair, the full replacement cost at current market price. We may apply the security deposit toward these amounts; you remain liable for any excess.
8. Late returns
Equipment not returned by the end date is charged, for each day or part of a day it is late, at 100% of the daily rental rate, in addition to any loss we suffer because the equipment is unavailable for other bookings. Late fees are added to your final invoice. Equipment not returned within a reasonable period after notice may be treated as lost or stolen and reported to the authorities.
9. Cancellations and changes
In the standard agreement you may cancel without charge until 48 hours before the pickup date and receive a refund of the deposit paid, less any payment-processing costs. Cancellations inside 48 hours, and no-shows, forfeit the deposit. We may cancel and fully refund a booking if the equipment becomes unavailable. Changes to dates or equipment depend on availability and may need a revised quote.
10. Liability, indemnity and default
You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable attorneys' fees, arising from your use, possession or operation of the equipment, except to the extent caused by our gross negligence or willful misconduct. The equipment is provided "as is". We are not liable for lost footage, lost production time, or indirect or consequential damages, and our total liability is limited to the rental charges you paid for the affected equipment.
If you breach the agreement, we may end the rental and retake the equipment, and you authorize us to enter the location where it is kept for that purpose. You will pay our reasonable collection costs, including attorneys' fees.
11. Governing law
The agreement is governed by the laws of the State of New York, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located in New York. The agreement, together with the accepted quote, is the entire agreement between you and us and can be changed only in writing. If a provision is unenforceable, the rest stays in effect.
Part 2: Website terms
12. Using the website
You may use this website to browse our equipment and services, build a quote request, contact us, and manage your booking in the client portal. Please do not use automated tools to scrape the site or submit forms, try to reach accounts, files or back-office pages that are not yours, or interfere with how the site works. Our forms use rate limits and bot checks, and a submission that looks automated may be discarded.
13. Rates, availability and estimates
Descriptions, photos, rates, availability and estimates on the website are for planning. Availability changes as bookings are made, and a request or an estimate is neither a reservation nor an offer. A rental is booked only as described in how a booking works, and your quote is your final price. We work to keep the site accurate, but it may contain errors, and it may change or be unavailable from time to time. If you see a mistake, please tell us.
14. Client portal accounts and uploads
Keep your portal password private, and tell us right away if you think someone else has used your account. You are responsible for activity under your account. We can disable an account.
Only upload documents you are entitled to share, such as a certificate of insurance or photo ID. Files must be PDF, JPG or PNG, up to 8 MB. Our team reviews each document and may reject it and ask for a replacement. See our privacy policy for how uploaded documents are stored and used.
15. Electronic signatures and records
When you accept a quote or sign an agreement online, you agree that your typed name and any signature you draw are your electronic signature, with the same effect as a handwritten one, and that we may keep an electronic record of it. We record your name, your consent, the time, your IP address and your browser details, and you receive a signed PDF copy by email.
16. Changes to these terms
When we change these terms we update the "Last updated" date at the top of this page. The version of the rental agreement you sign for a booking is the version that applies to that booking.
